The New Law for Protection of Minors in Media

With the enactment of the federal Youth Protection Act (Jugendschutzgesetz) and the Interstate Treaty on the Protection of Minors in the Media (Jugendmedienschutzstaatsvertrag, JMStV) of the states, a new regulatory framework for the protection of minors became effective in 2003. Especially the JMStV brought new forms of regulation, which had not yet been tested in practice and which draw on the concept of "Regulated Self-Regulation".

Project Description

In 2007 the institute, commissioned by the Federal Ministry for Family Affairs, Senior Citizens, Women and Youth, accompanied the legislative process with a number of statements. In a brief report on the question of state oversight of online services, the researchers analysed selected legal questions of the JMStV. For specific norms of the interstate treaty, a commentary is being developed, which will make the insights gained during the process available to academics and practitioners.
