Nichts für schwache Nerven?! Wie Bund und Länder den Jugendmedienschutz modernisieren wollen

The Law on the Protection of Minors from Harmful Media is too old and calls for modernisation. In the current issue of the journal Kinder- und Jugendschutz in Wissenschaft und Praxis [Protection of Minors in Science and Practice], Dr. Stephan Dreyer gives an overview of the planned changes, their points of friction and to what extent these changes can be sustainable.

Abstract
The German law on the protection of minors from harmful media must be modernised, because the legal regulations of the Federal Government and the Länder have long since become outdated and urgently need to be adapted to technical and user developments. In 2019, the Federal Government launched the reform of the Youth Protection Act, which is to be developed in an open-ended discourse and has the central objective of a convergent legal framework that extends the protection objectives and clearly formulates the instruments for achieving them. The Länder are following suit with a planned amendment to the JMStV. Terms, areas of application, age rating and competences are under discussion. The article gives an overview of the planned amendments, their points of friction and their possible role for a real, sustainable modernisation of the complex legal area.
