Automated decisions, especially those that work with AI, are accused of being opaque black boxes. In this article, Tobias Mast argues that this accusation is to be taken seriously, but that it becomes somewhat relative when contrasted with the criticism of human-generated decision-making rationales in the judiciary and administration. It explains the functions that decision rationales fulfil from a jurisprudential perspective and examines the qualities and shortcomings of human and machine approaches.
